My name is Allison Claire Guerriero. I am Charles Franklin McGonigal’s former girlfriend and an eyewitness to his criminal acts which took place from Summer 2017 – 24 December 2018 and I am respectfully submitting this letter for your consideration regarding the 16 February 2024 Sentencing Hearing for Mr. McGonigal, Inmate Number 91495-054.
I read the submission to this Court from United States Attorney Matthew M. Graves whose recommendation of a thirty month term of imprisonment accompanied with a mere $95,000 fine for Inmate Number 91495-054 is, in my opinion, not nearly sufficient for the American People to receive justice. I urge you in the strongest possible terms to impose the maximum sentence of sixty months imprisonment and for it to run consecutively with the Southern District of New York’s fifty month sentence.
I am “the perpetrator” Pamela McGonigal, Inmate Number 91495-054’s spouse, referred to in her letters to both you and Judge Reardon in the Southern District of New York. Please allow me the opportunity to explain to this Court the reason for my own actions:
During and after the dating relationship and cohabitation between Inmate Number 91495-054 and myself I observed and witnessed what I believed were criminal activities that Inmate Number 91495-054 was convicted of and also many he was never even charged with, indicted for, and certainly never convicted of. In fact, I was excused from testifying to the Grand Jury of this Court by Assistant United States Attorney Elizabeth Aloi. I was never called as a witness in the Southern District of New York by United States Attorney Damian Williams. The Federal Bureau of Investigation never adequately investigated this case despite my many attempts to instigate a criminal probe. The United States Department of Justice investigative bodies tasked with uncovering Inmate Number 91495-054’s crimes never wanted to hear or admit that their superstar is a traitor. For this, I experienced tremendous grief and financial hardship.
It was and still is my belief that the reason Inmate Number 91495-054 would only ever be convicted was if I were to fall on my sword. So that is what I did. I spent a night in jail and I would do it again, unhappily but without complaint, because I did that for the benefit of the victims in this case. Yes, I did harass the McGonigal family. I did so knowingly and with the intent of achieving my goal which was for Inmate Number 91495-054 to file a criminal complaint for the purpose of entering evidence against him and others at the Federal Bureau of Investigation into publicly accessible court records which he did.
In December of 2021 Inmate Number 91495-054 was still not indicted, still committing his crimes, still laundering blood money, and betraying the American People. I decided then to violate a restraining order which I allowed to be put into place and never fought in an attempt to provide this Court and others with the opportunity to retrieve that evidence in a publicly accessible manner. Whether this venue or others decide to take the information in those court proceedings to further investigate Inmate Number 91495-054 is not within my control.
Upon my realization that Inmate Number 91495-054 was betraying America I identified and concluded that Inmate Number 91495-054’s weakness was his family. I do not enjoy being cruel, I am not now and did not ever have fun doing this, but I knew all along that my duty to America and our nation far exceeded my own comfort level as well as Inmate Number 91495-054’s whose treasonous acts have put us all in grave danger.
My actions came at the expense of public humiliation, a binge drinking problem, Post Traumatic Stress Disorder, a criminal record, and legal fees which I will never live long enough to be able to pay off in their entirety.
Our National Security was at risk and still is due to the actions of Inmate Number 91495-054. Untold numbers of innocent human beings who cooperated with our government’s Intelligence Community and Law Enforcement Community and possibly our Military Community have suffered, perhaps even been killed, and incarcerated unjustly based on falsified information Inmate Number 91495-054 presented in several federal court districts throughout the United States of America as well as the acts that he committed for the purposes of enriching himself.
Only the passage of time will provide us with a glimpse of the damage inflicted upon those victims – you and I are two of those victims along with our fellow Americans – and the monstrous activities of Inmate Number 91495-054 will forever change the landscape of this nation and others.
As the Federal Bureau of Investigation as well as other United States Government agencies audit his past cases please also consider the mighty task those serving us all are faced with now while they do it. This was a monumental betrayal perpetrated by Inmate Number 91495-054 not only against America but also the world.
The severity and extent of Inmate Number 91495-054’s crimes is so far-reaching and complex that the victims in this case will never receive true justice nor will we ever know how many victims truly exist. Please take into consideration that ALL of the American People, our nation’s allies, and even innocent civilians in countries who are hostile to the United States have suffered and will continue to suffer due to the crimes Inmate Number 91495-054 committed.
I am horrified by the criminal acts of Inmate Number 91495-054. This is a man who embraced evil and sprinkled his vicious and unforgivable crimes inflicted on innocent people throughout the globe and he is, in my opinion, undeserving of mercy. His ability to manipulate and endear others within his orbit and pull us into his deceptive and demonic world is extraordinarily remarkable and seductive, but malicious. This man is the personification of the Devil.
The confluence of events which led us here today has been traumatic for me however it was my civic duty and responsibility to ensure this man would be investigated and convicted. As I said many times, I would do it all again.
It is my belief that Inmate Number 91495-054 is a sociopath who knows what he is doing is wrong, hurtful, evil and even satanic in some instances.
Inmate Number 91495-054 simply does not care who he hurts as evidenced by his unwillingness to reimburse me the measly $10,000 I had to spend when Pamela McGonigal knowingly made false and derogatory statements about me in court. I desperately need that money in order to survive now. He would prefer to continue to allow me to utilize my own First Amendment rights at the expense of his own wife and children who he claims in his letter to this Court and others are his primary concern. Clearly he has no concern for their well-being and familial peace. If he did care about them, he would negate my ability to use harvested images of himself and his family from the public domain in my effort to remain relevant enough (without violating any laws and utilizing my own God Given First Amendment rights) to secure my own book deal and sell my own intellectual property.
As recently as five days ago from the today Inmate Number 91495-054, who had made a commitment to this Court and others to seek treatment for alcoholism was observed publicly consuming alcohol and brazen enough to allow himself and others to be not only photographed but also posted into the public domain. This is not a man who exhibits remorse or a willingness to help himself, his family, and society. He continues to flaunt his lifestyle and blood money to be put on display for all to see! His dishonest nature is cemented into the minds of many.
Put simply: The Devil never comes to you with red horns and cape. He comes to you as everything you ever wanted. That Devil IS Charles Franklin McGonigal, Inmate Number 91495-054, whose crimes against humanity will have a lasting detrimental effect on the world. It is imperative that this man be incarcerated for the purpose of protecting the victims and their families as well as for the purpose of victimizing anyone else for as long as possible.
The blowback Inmate Number 91495-054 inflicted upon the world will be enormous and it is a stain on the legacies of those who came before us and gave their lives to this nation. Their sacrifices, legacies and gifts to us are enshrined in nothing other than their own blood. Please don’t squander their sacrifices, legacies, and gifts to us by allowing this man one more second of undeserved freedom. Please extend the sentence beyond the thirty months recommendation from the United States Attorney Graves and impose the maximum sixty months.
